Travel to and from Australia for 5 Years

The child holding the Adoption Visa (Subclass 102) can travel to and from Australia as many times as they want for 5 years from the date the visa is granted. However, after the initial 5-year travel facility, they will need to apply for a Resident Return (RRV) visa to re-enter Australia as a permanent resident. Alternatively, they may consider applying for Australian citizenship, which would eliminate the need for a visa to enter Australia. How Long the Child Can Stay

The Adoption Visa (Subclass 102) grants the child permanent residency, allowing them to stay in Australia indefinitely. The child becomes a permanent resident on the day the visa is granted.

Include Other Children

  • The child must have been or be in the process of being adopted through an intercountry adoption between two countries (other than Australia) that are parties to the Hague Convention on the Protection of Children and Cooperation in Respect of Intercountry Adoption.
  • The child must have been adopted through an expatriate adoption by an Australian citizen, an eligible New Zealand citizen, or the holder of an Australian permanent visa. The adoption must have taken place outside of Australia, and the adoptive parent must have resided outside of Australia for more than 12 months immediately before lodging the visa application.

It is important to seek legal advice if considering an expatriate adoption, as the Australian Government does not have a role in the overseas expatriate adoption process. Independent legal advice should be obtained both in Australia and the child's country of usual residence before proceeding with an expatriate adoption.

Sponsor Eligibility

In order to sponsor a child for the Adoption Visa (Subclass 102), the sponsor must meet the following eligibility criteria:

  • The sponsor must be an Australian citizen, eligible New Zealand citizen, or hold an Australian permanent visa.
  • The sponsor must be the child's adoptive parent or prospective adoptive parent.
  • The sponsor must be 18 years of age or older.
